Construction Defect Analysis

Construction defect cases turn on the gap between what was promised and what was built. We inspect the work, hold it against the plans and the code, and document exactly where the gap is (or show that there isn’t one).

What We Do

We examine the structure, materials, and workmanship, then compare what we find with the contract documents, the approved plans, and the building code in force when the work was done.

When something fails, we identify the mechanism: Was it a design problem, a construction problem, a materials problem, or normal wear and tear that nobody is responsible for?

Each answer points the case in a different direction, and we will not stretch the evidence to reach a convenient conclusion.

The Typical Questions We Answer

  • Was the work built in accordance with the plans, specifications, and code?
  • What is the actual cause of the failure or deficiency?
  • Is this a defect? Or is it ordinary wear and maintenance?
  • What is a reasonable scope and cost to correct it?

Why WindForce Forensics?

We don’t just litigate buildings.

We design and inspect them every week, which means our opinions on the standard of care are based on current practice rather than memory.

When we tell a jury what a competent contractor should have done, it carries weight because we have recent experience doing the actual work.
